This category applies when a taxpayer fails to meet certain obligations, either willfully or negligently. These duties are essential for the proper functioning of the tax system. Here are a few examples of where you might slip up:

  • Not registering with SARS: Failing to register for taxes or not notifying SARS when your personal details change can be an offence.
  • Not submitting returns: Missing deadlines for submitting returns or other key documents is a serious issue.
  • Not retaining records: If you don’t keep proper records of your tax affairs, as required under the Tax Administration Act (TAA), this could lead to penalties.
  • Not appointing a representative taxpayer: If you are required to appoint someone to manage your tax affairs and fail to do so, this can result in non-compliance.

If you’re found guilty under this category, you could face a fine or imprisonment for up to two years. This means that even if your actions were unintentional, such as forgetting to file on time or missing a change in your registration details, the consequences could still be serious.

Category 2: Intentional Non-Compliance and Fraud

The second category is for more deliberate acts of non-compliance. This includes actions where a taxpayer willfully tries to mislead or obstruct SARS in the discharge of its duties. Offences in this category could include:

  • Submitting false information: If you knowingly submit a false return or a false document to SARS or another person, this is a criminal offence.
  • Obstructing a SARS official: Interfering with a SARS official during an audit or investigation, or refusing to assist, is a serious violation.
  • Fraudulent acts: This could include forging documents, falsifying financial records, or making false statements to evade tax or to receive an undue refund.

If convicted of these more serious offences, you could face a fine or imprisonment for up to five years. Even worse, if SARS finds that you intentionally committed fraud to evade tax, the penalties could be much harsher.
